FCCPA Civil Remedies

The Florida Consumer Collection Practices Act (FCCPA) regulates the collection of consumer debts within the state of Florida, and provides consumers with certain rights and protections. My previous answer described the remedies and damages that can be obtained under the Fair Credit Reporting Act (FCRA) instead.

The Florida Consumer Collection Practices Act (FCCPA) provides the following remedies for consumers:

  • Statutory damages up to $1,000 for each violation
  • Actual damages the consumer suffered
  • Attorney’s fees and court costs
  • Injunctive relief, which is a court order to stop the conduct that’s in violation of the act.

It is important to note that, the FCCPA applies to any person who regularly engages in the business of collecting consumer debts and also applies to creditors in certain cases, it also prohibits certain types of conduct, such as false or misleading representations, harassment, and abuse.
